    • Patent Marking: The Forest Group Decision & Beyond

      Canadian patent owners and licensees are closely watching the impact of the US Federal Circuit’s recent decision in Forest Group, Inc. v. Bon Tool Co.  The decision has sparked controversy and triggered a surge of false marking lawsuits. With potential liability of up to $500 for each mismarked product, many patent owners and licensees have questions about false patent marking laws, and the scope of liability in the US.

      Brenda Leeds Binder is counsel with Fish & Richardson’s Silicon Valley office. Ms. Binder’s practice includes patent prosecution and licensing in the areas of mechanical devices, oil and gas technology, medical devices, computer software, semiconductor fabrication processes, web-based applications, comestible processes, MEMS devices and printer hardware. Ms. Binder has experience conducting intellectual property due diligence, non-infringement and invalidity opinion work and licensing.  She has spoken to numerous legal and industry groups on patent topics including the Banff Venture Forum Intellectual Property Workshop, Canadian Institute Protecting Intellectual Property Rights in the Energy Sector” Conference and to the Licensing Executives Society.
